- Federal criminal matter. Client was charged with selling cocaine to an informant. Weight triggered no mandatory minimum sentence, but it was client’s 3rd felony drug conviction – all in federal court. Client faced enhanced sentencing as he was deemed a career offender. Guidelines said he should get 151 months (12 ½ years). We argued for 8 years (96 months). The Court sentenced client to 100 months, a little over 8 years. D.W. April 2019
- Traffic Violation Trouble? See how we can help. A junior in college with a good academic record but a terrible driving record came to see me. What can be done? His driving history showed 7 outstanding matters; all carried license suspensions. A divide and conquer strategy was implemented. Contact was made with the court for each of the matters and hearings were set. Given the passage of time, two hearings resulted in dismissals because the officers were not present. For the 5 others, negotiation led to guilty pleas. But admissions of guilt only to those violations which carried a fine and not a license suspension. It took 9 months to accomplish, but now this college senior can look forward to graduation knowing that he can legally drive to his first job.
- Client was charged with burglarizing his neighbor’s home Police came to house to arrest him. He would not leave. More police showed up. After a 90 minute standoff, client was arrested and had some struggles with police getting in and out of police car. Client faced multiple felonies related to the home invasion and aggravated assault on a police officer. Pre-trial motions got rid of some of the charges. Leading up to trial, the judge ruled we could cross examine the government witnesses and present evidence in our case about the deal my client had with the homeowner because it showed a motive to lie and say client broke into his home. The deal was client provides labor and materials for a porch deck and ramp and homeowner provides client with marijuana. Once that ruling was made, the case was resolved for a guilty plea to a misdemeanor assault on the officer and 18 months’ probation. All other charges – including three felonies – were dismissed.
